Pursuant to the selection process, the petitioner’s name appeared as waitlisted candidates No.1. The selected candidates were issued appointment orders and they had accordingly joined in the two vacant posts. At that stage, the petitioner took up a plea that there was one more vacancy available and he ought to have been considered against the additional vacancy. The aforesaid claim of the petitioner was rejected by the learned Chief Judicial Magistrate, Cachar, Silchar, on 11-04-2014. Thereafter, a fresh advertisement notice was issued for filling up four vacant posts of Peon in the establishment of Chief Judicial Magistrate, Cachar, Silchar. At that stage, the petitioner had approach this Court by filing WP(C) No. 2479/2014, seeking a direction that he be appointed against one of the vacant posts on the basis of his position in the select list as a waitlisted candidate. On 19-05-2014, this Court had passed an interim order directing that one post of Peon be kept vacant. As such the authorities proceeded with the selection process for filling up three vacant posts by keeping one post vacant. Eventually, by order dated 13-02-2019 passed in WP(C) No. 2479/2014, the prayer of the petitioner was rejected by this Court. However, while disposing of the writ petition, the learned Single Judge had directed that the respondents shall not fill up the vacant Grade-IV posts without considering the candidature of the petitioner.
