It is submitted that the petitioner’s father, Jiban Ch. Baruah, a Grade-IV employee (Khalasi) in the office of the Assistant Executive Engineer, PWD (Roads), Golaghat, NEC SubDivision, Died-in-Harness on 30.11.2015, leaving behind his wife and two daughters including the petitioner, who is unmarried. The petitioner having requisite qualification, on 05.02.2016 submitted an application before the respondent No. 5, the Executive Engineer, PWD (R), Golaghat, NEC Sub-Division for consideration of her case for compassionate appointment under the Die-in-Harness scheme of the State. Though the petitioner’s father served in the Golaghat, NEC Sub-Division of the PWD (R), but the head office of said Executive Engineer, PWD (R), Jorhat, NEC Division is at Jorhat and as such, the DLC, Jorhat in its meeting held on 05.04.2018 considered the case of the petitioner and came to a finding that as there was no vacancy available for compassionate appointment under 5% quota, her case may be considered as per clause 15 of the Office Memorandum No. ABP 50/2006/pt./182 dated 01.06.2015 and her name may be recommended in any other departments on the ground of available vacancy in the next DLC. Subsequent to that the DLC, Jorhat in its meeting held on 25.10.2019 though considered the case of the petitioner for her compassionate appointment but could not recommend her name due to non-availability of vacancy.
