The present Interlocutory Application has been filed for condoning the delay of 100 days in preferring the connected writ appeal.

The reasons for the aforesaid delay have been stated in Para Nos. 2, 3 and 4 of the Interlocutory Application.

In brief, the plea taken by the applicant is that though the matter was heard before the Principal Seat of Gauhati High Court, the judgment was declared in the Outlying Bench of this Court (Kohima Bench) because of which it could not be immediately noted by the Bank and as such, the delay has occurred in processing the appeal.

Mr. Saikia, learned counsel appearing for the respondents has not seriously resisted the application.

Having heard the learned counsel for the parties and also having considered the reasons assigned by the Bank for the delay in filing the connected appeal, we are satisfied that sufficient reasons have been assigned justifying the delay in filing the connected writ appeal.

Accordingly, we allow this Interlocutory Application by condoning the delay of 100 days in preferring the connected appeal. Let the connected writ appeal be registered & numbered and listed accordingly.

Registry to register and number as well as list the connected appeal.

The present Interlocutory Application is, accordingly, disposed of.
