According to the counsel for the bank, the total due amount is Rs. 22,30,835.85/- by 24.02.2026. Counsel for the applicant submits that earlier also he has transferred Rs. 3.50 Lac from his account.
Let the applicant deposit the due amount. On the payment of above mentioned due amount, the account will get closed and auction scheduled on 25.02.2026 will not take place, if this amount is deposited by 24.02.2026.
After payment is made, No Dues Certificate will be issued to the applicant herein who is the guarantor in the matter. He gets the subrogation rights entitled to get this money which he had paid from the borrower. The title documents shall be handed over to the mortgagor without any ifs and buts upon payment of the entire due amount.
In view of the above, SA stands disposed of, all pending IAs also stands disposed off, if any.
