The matter was listed in Lok Adalat, but no settlement was arrived at. The counsel for the applicant has argued that the pendency of the Securitization Application has not been disclosed before the CMM under Section 14 of the Act of 2002. He further submits that they have raised the objections and reply to the same was given to the respondent bank, but before CMM, the bank has not disclosed about the receiving of the objections and giving reply to it.

Though, it is a fact that Section 14(3) of the SARFAESI Act, 2002 provides absolute immunity to the Chief Metropolitan Magistrate (CMM) or District Magistrate (DM) and their authorized officers for any action taken in good faith regarding the possession of secured assets. Under this section, no such action can be questioned in any court or authority.

There was an option for the applicant to settle the matter for Rs. 25.00 Lac, he submits that their clients are in talks with the respondent bank who have offered Rs. 22.00 Lac. Let the applicant do so and settle the matter with the person with whom they are in talks.

Except above objection no point is argued. There is no merit in this Securitization Application, therefore, the Securitization Application stands dismissed. File be consigned to record, as per rules. Copy of order be uploaded on website.
