In this matter, the applicant has not challenged any of the action of the bank and the relief claimed by them is only for quashing notice dated 16.01.2026. The said notice is only intimation to the applicant to remove their articles from the property which was already sold.
The counsel for the applicant further submits that vide order dated 03.02.2026, the respondent bank was directed to file complete details and had they filed the details, they would have challenged the action. One civil suit is pending, but not mentioned in SA
It is very sorry state of affair that advocates are officers of the Courts, but they are giving blame to another advocate that he was instruction to withdraw, but has not withdrawn the civil suit. Be that it may be, it was the duty of the applicant to disclose everything correctly in the pleadings.
The counsel for the applicant submits that the applicant has not told him about the pendency of the civil suit. Be that it may be, everything has already been concluded according to the bank and

excess amount has already credited into the account of the
applicant. No challenge to any SARFAESI action is made.
In view of the above, nothing survives in this Securitization Application, therefore, the same stands dismissed.
