(iv) ln order to secure the aforesaid sanction, the defendants executed a Deed of Hypothecation dald 25.07.2019 wherein hypothecated the stocks of fishery to be maintained in 1.76 acres of pond lying and situated at Majida, P.O.- Purbasthali, Dist.Burdwan; copy of which is annexed and marked as Annexure "F". 3. The defendants availed and enjoyed the said loan facilities by opening Accounts in applicant Bank, but did not comply with the agreed terms and conditions of said facilities, thus violated the terms and conditions of the aforesaid sanction. The defendants did not repay the outstanding and overdue interest of loan accounts. Despite several requests made by applicant Bank, the defendants did notpay any attention to regularize the Accounts; consequently, the accounts became irregular and was classified as NPA. Since the defendants / borrower(s) failed to liquidate the dues with the applicant Bank inspite of repeated requests and reminders, the applicant Bank compelled to issue Notices dated 03.11.2022upon the defendants calling upon them to repay an aggregate sum of Rs.19,14,6/,Ol-, but the defendants did not comply thesaid Notice, copy of said Notices dated 03.11.2022 are annexed and markedas Annexure 'G'. Certified copies of Statement of Accounts along with Certificate underBankers' Books of Evidence Act, along with statement of Claim, Annexure'H', have beenfiled to show andprove the dues, with further interest thereonas per terms of agreement, till
