(xv) The defendant No.1 signed and executed a Barance confirmation Letter dated 05.11 .2021 in favour of appricant Bank confirming his debt & riabirity. copy of Barance confirmation Letter dated os.11.2021is annexed and marked with Annexure ,A_1g,. 3. The defendants avaired and enjoyed the aforesaid roan facirities by opening Account in Bank's Barampura Branch, p.o.- Matiberuan, Dist.- paschim Medinipur. However, the defendants did not compry with the agreed terms and conditions of said facilities. The defendants did not repay the outstanding Bank,s dues and overdue interest of roan accounts. Despite severar requests made by appricant Bank, the defendants did not pay any attention to regularize the Accounts; consequenfly, the accounts became irregurar and was crassified as NpA. since the defendants / borrower(s) failed to liquidate the dues with the applicant Bank inspite of repeated requests and reminders, applicant Bank compelled to issue recall / demand Notice dated 0307.2023 upon the defendants through its Advocate cailing upon them to repay the outstanding Bank's dues, but the defendants did not compry the said Notice, copy of said notice dated 03.07 .2029 is annexed and marked as Annexure ,A-19,. certified copies of statement of Accounts along with certificate under Bankers, Books of Evidence Act, with lnterest calculation sheet, Annexure'A-20', have been filed to show and prove the dues, and future interest @ 10.70yo per annum compounded annuaily with monthry rests thereon from 01.06.2023, till actual realization, has been prayed Applicant Bank submitted that their claim in the application is within limitation.
