The Applicant^{Bank filed the present OA against Defendants for} recovery of a total^sum of^{R;s,22,79,062/- (Rupees TwentyTwo} Lakhs Seventy Nine^{Thousandand Sixty Two only) with future} interest @ 18o/o^{p.a from date of filing of OA till the date of realization} and in default for^{sale of hypothecatedproperty as mentionedin the} schedule to OA.

Z. As^per the averments^{in the application, the Applicant Bankstates that} defendant no.1^is a^{sole proprietorship concernrepresentedby} defendant no.2^{who is both borrower and guarantoravailedcash credit} loan of 20.00 lakhs^{and agreed to repay within a periodof 12 months.} Defendant no.1^{executed deed of hypothecationon 13.04.2022and} hypothecated the^{stocksin favour of applicant bank. Afteravailing the} loan facilities, the^{defendants failed to comply the terms of sanction,} hence the applicant^{bank classified the accountas NPA on 27.L0-2024} and issued^{recall notice dated 13.08.2025.Inspiteof several requests} and demands,^{the defendantsdid not clear the outstanding.Hence} this OA.

Ms. T. Swetha, Manager of^{the Applicant Bank examined herself as} AW.1 and exhibited^{relevant documents,which are marked as Ex.A.t} to A.9.

Heard the Ld. Counsel^{for the Applicant Bank.}

The^point that arise^{for consideration is whether the Applicant Bank is} entitled for the claim^{made in the OA against the Defendants as} prayed for?

Defendants remained^{exparte. To substantiatethe case of the} Applicant Bank, AW.1,^{official of the Applicant Bankwas examinedand} he exhibited relevant^{documentsas Ex.A1 to A.9. In view of the} above, I hold that^{the Applicant Bank has establishedtheir claim made} in the OA against the^{Defendants and hence the Applicant Bankis} entitled to recover the^{claim made in the OA with future interest and} costs.

B. In the result, the^{present OA is allowed with costs, as under:} The Defendants are^{jointlyand severallyliable to pay to the Applicant} Bank a total sum of^{Rs.22,79,O621'(RupeesTwenty Two Lakhs} Seventy Nine Thousand^{and Sixty Two only) with future interest}
