The Applicant Bank fired the present oA against Defendants for recovery of a total sum of Rs.Sl,44,76S/- (Rupees Fifty One Lakhs Forty Four Thousand Seven Hundred and Sixty Five onty) with future interest @ 13.05o/o p.a with monthry rests from date of filing of oA till the date of realization and in default for sale of hypothecated movables as mentioned in the schedule to OA.

2' As per the averments in the apprication, the Appricant Bank states that defendant no.1 is a^proprietary concern represented by its proprietor/ defendant no.2 availed cash credit facility of Rs.50.00 lakhs on 17.10.2023. The defendants hypothecated all the movables as mentioned in the schedure to oA in favour of Appricant bank and executed all necessary documents. After availing the loan facility, the defendants faired to compry the terms of sanction, hence the appricant bank classified the account as NpA and issued legal notice dated 2L.10.2025. Inspite of severar requests and demands, the defendants did not clear the outstanding. Hence this OA.

6' The point that arise for consideration is whether the Applicant Bank is entitled for the claim made in the oA against the Defendants as prayed for?

7, Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A1 to A.9. In view of the above, I hold that the Applicant Bank has established their claim made in the oA against the Defendants and hence the Appricant Bank is entitled to recover the claim made in the oA with future interest and costs.

B. In the result, the present OA is allowed with costs, as under: The Defendants are joinfly and severaly riabre to pay to the Appricant Bank a total sum of Rs.S1,44,7651- (Rupees Fifty One Lakhs Forty Four Thousand Seven Hundred and Sixty Five only) with future interest @ 13.05o/o p.a from date of filing of OA till the date of realization;

The Applicant Bank is also entitled to proceed against the person and properties of defendant No.2 and properties of defendant no.1 firm towards realization of the debt due.
