Rajasthan Gramin Bank , herein after called as "RGB" (before amalgamation w.e.f. 01.05.2025 vide Gazette Notification S.O. 1633(E) dated 05-04-2025, known as Rajasthan Marudhara Gramin Bank), a Government of India Undertaking a body corporate constituted under the provisions of the Regional Rural Banks Act, 1976, having its Head Office at Jaipur with its Camp Office at Tulsi Tower, 9th B Road, Sardarpura, Jodhpur - 342003, Rajasthan and having branches across Rajasthan, including one of its Branch Office at Govindgarh, Dist. Jaipur (Raj.) presently represented through Stressed Assets Resolution Cell, Vaishali Nagar, Jaipur through its Sr. Manager Mr. Aditya Gopal Sharma.

JUDGMENT

This Original Application was filed by the applicant bank on 19.09.2025 for recovery of outstanding amount of Rs. 21,22,055/- from the Defendants.

As per the pleadings, the Defendant No. 1 & 2 are Borrower & Co-Borrower had applied and availed agricultural loan from the applicant bank's Branch related to the present O.A. earlier in the year 2009 and created the charge over the subject land and further for his enhanced need, the Defendant No. 1 & 2 Borrower & Co-Borrower again applied and availed agricultural loan under KCC from the applicant bank's Branch related to the present O.A. On the request of the Defendant No. 1 & 2, the applicant bank sanctioned loan under Kisan Credit Card Scheme (KCC) of Rs. 18,68,000/- in the year 2019 vide sanction letter dated 04.12.2019.

It is submitted that the defendant no. 1 created the charge over the agriculture land and mortgaged with the Applicant Bank for securing the payment of the dues of the said KCC loan facility.

It is submitted that the application is within the limitation as the letter of debt revival executed on 07.12.2022 in favour of Applicant Bank by the Defendants.

It is submitted that the Defendants however failed to liquidate and pay the dues of Account and the dues remained always outstanding for the said Credit Facility. After other Oral & Written Demands being made for liquidation of total dues, or for clearing the liability of the Credit Facility, related to the present O.A., on account of no steps being taken by the Defendants for liquidation of total dues, the Applicant Bank classified the Account as N.P.A. KCC Account No. 1 l 331875363 on 30.04.2025.

Defendants failed to maintain financial discipline and therefore, their loan account was classified as NPA. Applicant Bank has therefore, filed this original application for recovery of its dues against the Defendants.

Summons were issued to the Defendants on 06.11.2025 and court commissioner was appointed for dasti summons. Commissioner report has been filed. Defendant no. 1 is the father of the Defendant No. 2 and Defendant No. 2 was available but refused to take the summons and also did not permit to affix the summons. In these circumstances it is admitted that the defendants are intentionally, deliberately, and willfully not paying the dues of the Bank.

Heard arguments and perused the record.

As stated supra, the Applicant Bank filed the evidence affidavit of Shri Aditya Gopal Sharma coupled with the recitals in the documents, viz Exhibit A/1 to A/10 marked on behalf of the applicant bank, clinches the claim of the applicant bank against the Defendants. Hence, I hold that the

Defendants are jointly & severally liable to pay to the applicant bank the claim made in O.A. with future interest and costs.

In the result, this O.A. No. 1544 of 2025 is allowed declaring that:-

a) The Defendants are jointly & severally liable to pay to the applicant bank a sum of Rs. 21,22,055/- (Rupees Twenty One Lac Twenty Two Thousand and Fifty Five Only) with pendente lite and future interest @ 10% (simple) from 08.09.2025 till the date of realization.

b) The applicant bank is entitled to recover the above amount from the sale of hypothecated assets and charged/mortgaged agriculture land bearing Khata No. 175 (Present 280), earlier Khasra No. 256/2, 257/2, 276/2034, area 2.89 Hectares which subsequently changed to Khasra No. 434-437, 605609, area 2.7312 Hectares at Village Badhawali, Patwar Halka Dhodhsar, Tehsil- Chomu, Dist Jaipur (Raj.) belonging to Defendant No. 1 and as well as from the personal movable and immovable properties/assets of Defendants. The applicant bank is entitled to proceed against the same towards recovery of its debt.

c) The applicant bank is entitled to the costs of the O.A.
