The Applicant Bank filed the present oA against Defendant for recovery of a total sum of Rs.24,2S,2SOl_ (Rupees Twenty Four Lakhs Twenty Five Thousand Two Hundred and Fifty only) i.e.,

A) a sum of Rs.8,24,458/- in respect of term roan account with current and future interest @ 13.800/o p.a with monthry rests from 24.04.2025 till the date of realization;

B) a sum of Rs.16,00,7g2/- in respect of term roan account with current and future interest @ 14.55o/o p.a with monthly rests from 23.04.2025 till the date of realization;

As per the averments in the apprication, the Appricant Bank states that defendant availed personal loan of Rs.10.00 lakhs vide letter of arrangement dated 26.09.2022 and executed personar roan agreement in favour of Appricant bank. The defendant again avaired Xpress Credit scheme of Rs.16.00 lakhs on 26.09.2023 and executed personar roan agreement. After avairing the roan facirity, the defendant failed to comply the terms of sanction, hence the applicant bank crassified the account as NpA and issued regar notice datecr 71.04.2025. smt Kalyani Rathod, Manager of the Applicant Bank examined himserf as AW.1 and exhibited relevant documents, which are marked as Ex.A. 1to A.12.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant Bank is entitled For the claim made in the oA against the Defendant as prayed for?

Defendant remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A1 to A. 12. In view of the above, I hold that the Applicant Bank has estabrished their craim made in the OA against the Defendant and hence the Applicant Bank is entitled to recover the claim made in the oA with future interest and costs.

The Defendant is liabre to pay to the Appricant Bank a totar sum of Rs.24,25,25O/- (Rupees Twenty Four Lakhs Twenty Five Thousand Two Hundred and Fifty only) i.e.,

The Applicant Bank is also entitled to proceed against the person and properties of defendant towards realization of the debt due.

The Applicant Bank is entiiled to the costs of the oA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.
