This SA is filed challenging the auction conducted by the respondent bank in respect of schedule property on 26.06.2023 in pursuance of E-auction sale notice dated 05.06.2023.
This application is resisted by the respondent bank by filing reply statement.
Heard both the counsels.
During the course of arguments, the Ld Counsel for respondent submitted that even though the auction was conducted on 26.06.2023, the same was cancelled later and enti s returned to the auction purchaser and so the SA beco s liable to be dismissed.

The Ld counsel for applicant submitted that by recording the statement made by the counsel for respondent bank, the SA may be dismissed. Hence in view of the circumstances stated above, I hold that there is no need to adjudicate anything in this SA and hence the SA.No.226/2023 becomes infructuous.
In the result, 9A.No.22612023 is dismissed with no costs.
