41 As per Annexure A-2 copy of Sale Deed dated 25.05.2018, the purchase value of the shop has been reflected as Rs.23,00,000/(Rupees Twenty-Three Lacs only). Admittedly, the respondent bank has sold away the same in e-auction for Rs.22,11,111/- (Rupees Twenty-Two Lacs Eleven Thousand One Hundred Eleven only). The applicants have not produced any valuation report of any authorized valuer in order to ascertain that the value of the property was more than Rs.23,00,000/- (Rupees TwentyThree Lacs only). When the mortgaged property is sold away by the financial creditor, nobody come forward to purchase the same being disputed and in such circumstances, some time the secured asset is to be sold at a some lower value. Sometime, even value of property goes down due to so many reasons. As the onus was on the applicants to prove that the value of the secured asset was more than Rs.23,00,000/- (Rupees Twenty-Three Lacs only) at the time of sale but they failed to discharge this onus.
