1. The learned counsel appearing for the applicant bank has
filed I.A. No.1387/2025 seeking withdrawal of this O.A.
The learned counsel for the applicant submits that, this O.A.

is filed for recovery of Rs.22,38,696.49/- from the

defendants. However, in the meantime the defendants have

regularized their loan account and the said loan account is

upgraded. As such applicant Bank do not want to proceed

further, and wants to withdraw the Original Application with

liberty to file fresh O.A. in case the defendants make any
default in future in repayment of the loan facility availed by
them.

2. The counsel requests for return of the original documents
and also refund of the court fees as per rules.
3. Heard.
4. In view of the regularization and up-gradation of loan
account, I pass the following order. ORDER
A. As the loan account is regularized and upgraded, the O.A.
No. 803/2024 stands disposed of with liberty to file fresh
O.A. in case the defendants make any default in future in repayment of the loan.
B. The original documents, if any filed be returned to the
Authorised Officer of the applicant bank as per rules.
C. The Court fees be refunded as per rules and as per the orders
passed by the Hon’ble Bombay High Court.
D. Consign the file to the Record Room.

Authorised Officer of the applicant bank as per rules.

passed by the Hon’ble Bombay High Court.

D. Consign the file to the Record Room.
