The Applicant Bank^{filed the presentO.A. being No' o A /21512023 on 25104/2023tot} recovery of a total^{sum of Rs. 34,43,4061-(ThirtyFour Lakh Forty Three ThousandFour} Hundred and Six)only^{from the Defendantstowards Home Loantogetherwith interest' cost} and other usual^reliefs.

As stated supra,^{the Defendant remained absentand did not turn up to controvert the} version of the^{O.A.of Applicant Bank, The EvidenceAffidavitcor]pled withthe recitals in the} documents^{viz., Exhibits Annexure-A1 to Exhibit Annexure-A12 markedon behalfof the} Applicant Bank,^{establishedthe claamof the Applicant Bank againsttheDefendants andOA} schedule^{properties. Hence, I hold that the Defendants are jointly and severally liable to pay} to the Applicant^{Bank the claims madein the OA with future interest and costs'}

(1) O.A. No. 215 ot 2023^{filed by the ApplicantBank is allowed and debt is determinedwith cost} against the^{defendants, It is hereby orderedthat applicant bank is entitledto recoverfrom} the defendants^{the totalamount to the tuneof Rs Rs' 34'43'406/- (Thirty Four Lakh Forty} Three Thousand^{Four Hundred and Six) only with pendenteliteand future interest@} 8.35o/operannuminterestduefromthedateoffiIingoftheoriginalApplicationi.e. 25.04,2023 till^{full and finalrealization of the claimamount'}

(2) Amount, if any,^{paid by the defendantsin the loan accounts or amount' if any' recoveredby} the Applicant^{Bank after filingof the O A the same be taken intoaccountwhile arriving at} the exact amount^{of dues/debt payable by the defendants, Accordingly, pendentelite and} future interest^{shall be calculated on the reducedamount'}

(3) Defendants are debarred^{from disposing, alienatingor dealingwith any of theproperties} belonging to^{them till the aforesaid decretaldebt is recovered from the defendants'}

(4) Defendants are^{given a time of thlrtydays from the date of the JudgemenvFinal Orderfor} repaying of^{the above mentioned dues,so intimated to them'In casethe defendantsfail to} pay the dues^{within the above mentionedtime' the applicant bank is entitledto recoverits} dues by sale^{of secured assets, if anyApplicant bank is also entitled to proceed against} personal^{propertiesof the defendants(Bothmovableand immovable)and alsoproceed} against the^{defendants personallyto recover the dues in accordancewith law'}
