through Sh. Ravi Kumar, Chief Manager o f the applicant bank, who is competent to institute the Original Application vide Power of Attorney dated 17.11.2009, which is Annexure A1 to this OA. 2. The brief facts of the OA are that Late Sh. Jagdev Singh @Sh. Jagga Singh @Joga Singh had approached the applicant bank for the grant of KCC Limit of Rs.20.00 Lacs vide Loan Application dated 04.03.2017, which is Annexure A2 to this OA. 3. The applicant Bank sanctioned the KCC Limit of Rs.20.00 Lacs vide Memorandum of Sanction Letter dated 20.03.2017, which is Annexure A3 to this OA and the terms and conditions were duly accepted by the defendants. 4. Late Sh. Jagdev Singh @Sh. Jagga Singh @Joga Singh had mortgaged his immovable property i.e. land measuring 12 Bighas 13 Biswas situated at Village Gurdasspura, H.B. No.75, Tehsil and District Rupnagar, Punjab vide Declaration u/s 4(1) of Punjab Agricultural Credit Operations and Misc. Provisions (Banks) Act, 1978 and Mutation both dated 09.03.2017 along with their translations, which are Annexures A8 and A9 to this OA. Documents executed:- Hypothecation agreement, Consent clause and Declaration regarding agricultural land and Manager certificate all dated 20.03.2017, which are Annexures A4 to A7 to this OA; Letter of forbearance from the legal heir and Balance and security confirmation letter both dated 12.03.2020, which are Annexures A10 and A11 to this OA; Recall notices dated 13.05.2020, which are Annexures A12 and A13 to this OA and Statements of account along with Memorandum of Interest, which are Annexures A14 and A15 to this OA. 5. On account of death of Late Sh. Jagdev Singh @Sh. Jagga Singh @Joga Singh, the loan account became irregular and was classified as NPA and after adjusting debit and credit entries in loan account there was a debit of Rs.36,37,830.00, which is recoverable and the defendants were served recall notices but they did not repay the
