Defendant No.-1 to 3 and one Ramchandra Agrawat as borrower and Defendant No.-2 & 3 and Ramchandra Agrawal in their individual capacity as guarantors in addition to execution of loan and guarantee documents have also created equitabte mortgage over the immovabte property, i.e., Diverted Land and Residential Buitding & Gowdown together with a[[ other construction &. erections thereon situated at Survey No.-121 l1l1 &. 1211112, total area 0.418 Hectares, i,e., 4180 sq.mtr, at Kasba Chawni, Barod Road, Tehsit & District-Agar Matwa (M.P.); betonging to Ramchandra (Ramprasad) Agrawat. The Defendant No.-1 to 3 and Ramchandra Agrawat avaited the credit facilities and atso executed Revival Letters and Batance Confirmation Letters lastty on 31 103/20. The Defendant No.-2 to 4 submitted an affidavit dated 22/07 /21 stating that Ramchandra Agrawal passed away on 01 /05/21 leaving behind Defendant No.-2 & 3 who are his Sons and Defendant No.-4 who is his wife as [ega[ heirs and have inherited his entire estate or properties. The accounts became irregutar and the Defendants faited to liquidate the outstanding dues despite issuance of Recatl Notice on 17/12/21 and initiation of action under the Securitisation Act by the Appticant Bank. The Appticant-Bank has retied upon the documents at Ex. A-1 to A-47 which were proved by Shri Tamrat La[ Kori, Chief Manager.
