The brief facts of the case are that the defendant No.l is partnership firm, of which, the defendant No.2 is proprietor and the defendant No.3 is guarantor in her personal capacity. The defendant No.l/firm through its proprietor approached the bank for grant of Working Capital Limit of Rs.55.00 lac, which was duly considered and sanctioned by the bank on vide its sanction letter dated 27.11.2019 on certain terms and conditions (Exhibit No.A-3) to this original application. 3. To secure the above credit facility ofRs.55.00 lacs, the defendant Nos.l & 2 had executed and signed various security documents in favour of the applicant-bank on 27.11.2019 like D.P. Note, Composite Hypothecation Agreement, Declaration Cum Undertaking Cum Authority and Letter of Continuing Security. The defendant No.3 being guarantor towards the credit facility had executed and signed General Form of Guarantee in favour of the bank acknowledging therein her liability same and equal with the principal borrowers (Exhibit No.A-4 to Exhibit No.A8) to this original application.
