Heard learned counsel for the parties and perused the records.

In compliance of the order 04.03.2025 an amount of Rs.17.60 lakhs wasdeposited by the appellant with the respondent bank. It is submitted by the learned counsel for the appellant that an amount of Rs.10.00 lakhs was deposited by the appellant as pre-deposit with the Registrar, DRAT, Kolkata. Learned counsel submits that said amount of Rs.10.00 lakhs may directly be transmitted to the respondent bank and the interest accrued upon the amount may be paid to the appellant.

Since settlement has already been arrived at between the parties at Rs.27.60 lakhs, which is duly recorded in the order dated 04.03.2025, and an amount of Rs.17.60 lakhs has already been deposited by the appellant with the bank, hence, Rs.10.00 lakhs be directly transmitted by the Registrar, DRAT, Kolkata to the bank.

Registrar, DRAT, Kolkata is hereby directed to transfer Rs.10.00 lakhs to the respondent Punjab National Bank’s Sundry A/c No. 079520317118A IFC PUNB0079520 and remit the accrued interest amount to the appellant in accordance with the rules.

When the bank received the amount of Rs.10.00 lakhs from the Registrar, DRAT, Kolkata, they should return the title deed along with other documents, if any, within seven days from the date of receipt of the amount.

Misc. Appeal No. 31 of 2024 stands disposed of. Costs easy.
