2. Heard the Learned Counsel for Appellant as well as Respondent No. 1 and perused the record. 3. Perusal of the record would show that an O.A. was filed by the Asset Reconstruction Company (India) Limited (ARCIL) originally filed by Development Credit Bank Limited against Defendants No. 1 to 8, i.e. Hyderbad Showbizz Centre Private Limited, Mohammad Imtiazuddin, Abrar Ahmed, Mohd. Qadeer Ali, Sri Lingala Gowridas, Siraj Anwar, Sri Jeetendra Agarwal and M/s National Insurance Company Limited, for recovery of Rs.52,58,871.68. Pending O.A., an impleadment application is filed by the Andhra Pradesh State Financial Corporation for impleadment as party Respondent. In the written statement filed by them wherein it is stated that loan was sanctioned by them on 7.8.2001 and 30.3.2001; hence charge, if any, over the property, is in their favour. It is further stated that equitable mortgage was created in their favour and title deeds were deposited. They have a prior charge over the property. 4.
