THE APPELLATE TRIBUNAL :
Learned Counsel for the Appellant submits that he has received the counter affidavit only on 21st March, 2023, and prays for some time.
It appears initially appeal was filed with a delay of about 583 days. Thereafter the appeal was dismissed on 22nd April, 2022 and the restoration application was filed on 14th December, 2022. This shows that the Appellant is contesting a luxurious litigation. Appellant is a Bank who could not be permitted to misuse the public money in this fashion. However, on the request of Learned Counsel for the Appellant matter is adjourned for the day.
