Received a Restoration Petition through online on 13/09/2023 and hard copy on 14/09/2023 being M.A. Dy. No. 626 of 2023 filed by Ld. Advocate Mr. Anjan Kumar Paul for Applicant with a request for recalling the order dated 02/08/2023 passed by Hon’ble Chairperson in Misc. Appeal Dy. No. 350 of 2023 and to restore the appeal Dy. No. 350 of 2023 and connected I.A. for condonation of delay.
Application fee of Rs.200/- vide Transaction Ref. No. 1309230047455 dt. 13.09.2023 has been paid online along with the application.
Received one affidavit on behalf of appellant bank from Ld. Advocate Mr. Anjan Kumar Paul wherein it has been stated that in compliance of order dated 20/07/2023 passed by Hon’ble Chairperson certified copy of impugned order is being filed.
Vide order dated 02/08/2023 passed by Hon’ble Chairperson, the certified copy of impugned order is not filed despite specific order dated 20/07/2023, accordingly appeal is dismissed in default.
