Heard the learned counsel for the appellant on the urgency application.
Learned counsel for the appellant contends that the present appeal has been filed against the judgment and order dated 07.01.2023 passed by the Tribunal below, whereby the auction dated 25.08.2010 has been set aside and the appellant, who is auction purchaser, has been directed to vacate the auctioned premises and take the auction money back along with interest, pursuant to which a letter dated 13.01.2023 has been issued by the respondent-Bank to the appellant. It is further contended that the appellant is residing in the premises in question since 2012, therefore, the interim prayer made in the appeal is required to be heard urgently.
In view of the above, the date already fixed for 27.04.2023 is preponed to 22.03.2023.
