Present: Shri Himanshu Mishra, counsel for the appellant, None for the respondent-Bank,
Heard the learned counsel for the applicant on the substitution application being I.A. No. 108/2023 and I.A. no. 106/2023 being delay condonation application.
It is contended that the appellant has no knowledge about the death of the appellant no. 1 and as soon as he came to know, he has moved the application for substitution along with delay condonation application.
For the reason stated in the delay condonation application, the same is allowed and delay is condoned. The substitution application is also allowed. Let the necessary substitution be made by the appellant in the array of parties 15 days. Thereafter, the appellant shall take steps within a week for service of notice upon the respondents as per order dated 02.02.2023. Affidavit of service along with proof of publication be filed by the next date.
