Heard the learned counsel for the applicants on the urgency application being I.A. No. 280/2023, which has been filed on the ground that when the matter was listed on 27.03.2023, interim protection granted earlier was not extended inadvertently, therefore the applicants apprehend that the Bank or auction purchaser might proceed with taking possession of the property in question of the appellant.
In view of the above, it appears that there is only apprehension of the applicant and there is nothing on record to show that the Bank or auction purchaser has taken any action for taking possession of the property in question. Hence, there is no urgency in the matter. Accordingly, the urgency application is rejected with liberty to file afresh application, in case any steps are taken regarding possession of the property in question.
List this case on the date already fixed i.e. 19.07.2023.
