Heard the learned counsel for the appellant.
The present appeal has been filed under section 18 of the SARFAESI Act against the interim order dated 15.09.2022 passed by the DRT, Dehradun in S.A. No. 127/2022, in which the delay condonation application being I.A. No. 76/2023 has also been filed. The S.A. No. 127/2022 is still pending consideration and after recording the conduct of the parties and considering the facts and circumstances of the case, the Tribunal below has passed the interim order on 15.09.2022, which does not warrant any interference by this Tribunal at this stage.
In view of the above, the present appeal is finally disposed off with the direction upon the DRT, Dehradun to consider and decide the S.A. No. 649/2022, which is stated to be pending, in accordance with law after affording opportunity of hearing to the parties concerned within two months from the date of production of certified copy of this order.
