Present: Shri A. K. Srivastava, counsel for the appellant, Shri Himanshu Tiwari, Advocate holding brief of Shri Rakesh Mishra, counsel for the respondent-Bank,
As per the office report dated 31.10.2023, notices have been served upon the respondent nos. 2/1 and 2/2, but none has put in appearance on their behalf. The said report further records that the notice sent to the respondent no. 2/3 has returned back with endorsement “insufficient address”. Let the appellant take fresh steps within 10 days for service of notice upon the respondent no. 2/3 by publication in the newspaper having wide circulation in the area. Affidavit of service along with proof of publication be filed by the next date.
Learned counsel for the respondent-Bank prays for some time to file reply to the delay condonation application. Let the same be filed by the next date, failing which appropriate order shall be passed.
