THE APPELLATE TRIBUNAL :

Application for condonation of delay in filing the appeal.
Impugned order was passed on 28th August, 2019 which was challenged before the Hon’ble High Court at Calcutta on 3rd October, 2019. Writ was disposed of on 13th November, 2019 with liberty to challenge the impugned order before the appropriate forum. Thereafter this appeal was preferred on 23rd December, 2019. Learned Counsel submits that delay in filing the appeal was not intentional.
Learned Counsel for Respondent Bank opposed and submitted that no ground has been made out for condoning the delay.
I have heard the Learned Counsel for the parties and have perused the record. I find the ground to be sufficient for condoning the delay.
Application No. 478 of 2019 is allowed. Delay in filing the appeal is condoned.
