Present: Shri Jahagir Hyder, Advocate holding brief of Shri Manu Khare, counsel for the appellant,
Perusal of earlier order dated 24.03.2023 shows that learned counsel for the appellant had contended that the respondent nos. 2 & 3 reside in Dubai and notices were also sent at their Dubai address, but no one had put in appearance on their behalf, therefore, the learned counsel prayed for some time to take steps for service of notice upon the respondents by publication in the newspaper, to which the order was passed.
The office report dated 29.05.2023 shows that no steps has been taken by the counsel for the appellant for service of notice upon the respondent nos. 2 & 3 and proof of publication regarding service of notice upon the respondent no. 4 has been filed.
No one is appearing on behalf of the respondents, therefore, the matter is proceeded ex-parte against the respondents as the appeal is of year 2013.
A mention has been made on behalf of the learned counsel for the appellant that the arguing counsel Shri Manu Khare is busy before the Hon’ble High Court, therefore, he is unable to appear before this Tribunal today, hence he seeks adjournment.
It is made clear that the matter will not be adjourned on the next date as the appeal is of year 2013.
