The office report dated 03.07.2023 shows that the reply of the respondent nos. 1 & 2 is on record, to which no rejoinder has been filed. The said report further shows that there is nothing on record to show service of notice upon the respondent nos. 3, 4 & 5 has been made.
Let the appellant take fresh steps within 10 days for service of notice upon the respondent nos. 3, 4 & 5 by publication in the newspaper having wide circulation in the area. Affidavit of service along with proof of publication be filed by the next date.
The aforesaid report further reveals that the I.A. No. 07/2023 being substitution application for substituting the legal heirs of the appellant no. 2 is pending consideration. Accordingly, the substitution application is allowed. Let the necessary substitution be made by the appellant in the array of parties within a week.
