Learned counsel for the appellants submits that in the present appeal, the sale is not under challenge, therefore, the auction purchaser is not a necessary party.
Learned counsel for the respondent-Bank has served a copy of reply upon the counsel for the appellant, who may file rejoinder by the next date.
Heard the learned counsels for the parties on the I.A. No. 113/2021, whereby a direction was sought for the office to refund Rs. 44.00 lacs, which was deposited by the appellant with this Appellate Tribunal towards pre-deposit.
Learned counsel for the appellant contends that he does not want to press the aforesaid application and the same may be dismissed as withdrawn.
Accordingly, the application being I.A. No. 113/2021 is dismissed as withdrawn.
