Learned counsel for the appellant submits that he shall serve the copy of appeal upon the learned counsel for the respondent-Bank during course of the day, who may file reply by the next date.
The office report dated 24.03.2023 shows that notice sent to the respondent no. 2 has returned back with endorsement ‘refused’. Accordingly, the service of notice upon the respondent no. 2 is deemed to have been made. The notice sent to the respondent no. 4 has also returned back with remark “the addressee is since deceased”. Let the counsel for the appellant do the needful for substituting the legal heirs of the respondent no. 4, if so desired. No tracking report has been filed to authenticate the service of notice upon the respondent no. 3. Let the same be filed by the next date, failing which appropriate order shall be passed.
