Present: Shri A. K. Pal, Advocate holding brief of Shri Amit Anand Mishra, counsel for the appellant, None for the respondent no. 1, Shri P. K. Bajpai, counsel for the respondents no. 2 & 3,
Pursuant to the earlier order dated 10.11.2022, 10 days’ further time was granted to take steps for service of notice upon the respondent nos. 4 to 8, but the office report dated 31.01.2023 shows that no steps have been taken by the counsel for the appellant till date.
The aforesaid order further indicates that the learned counsel for the respondent nos. 2 & 3 was to file reply by the next date, but no reply has been filed inspite of three opportunities being granted.
The appeal is of year 2017, therefore, as last opportunity, let the appellant take fresh steps for service of notice upon the respondent nos. 4 to 8 by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date, failing which appropriate order shall be passed.
Learned counsel for the respondent nos. 2 & 3 may file reply by the next date, failing which their right to file reply shall stand closed.
