Learned counsel for the respondents has placed a judgment dated 22.05.2023 passed by the Hon’ble Allahabad High Court in Civil Misc. Writ Petition No. 15805 of 2023 – Deepak Hada & 5 others Vs. Recovery Officer, DRT, Allahabad and another, whereby the writ petition was allowed, holding that no purpose will be served in going ahead with the sale proclamation, as the issue of payment of entire insured amount is pending before the NCDRC, for which expeditious disposal, the Hon’ble Supreme Court has already directed the said commission and without any dispute, the amount is to be paid either by the insurance company or by the respondents, therefore, till the decision of the NCDRC, the matter may be deferred.
Learned counsels for the parties do not dispute that the matter is still pending consideration before the NCDRC, which is likely to be decided in near future as stated by the counsel for the respondents and the Hon’ble Supreme Court has also requested the said commission to decide the matter expeditiously.
In view of the aforesaid, list this case on 27.10.2023.
