Pursuant to the earlier order dated 12.04.2023, the learned counsel for the respondent-Bank has filed reply after serving copy of the same upon the counsel for the appellant, who may file rejoinder by the next date.
Learned counsel for the respondent-Bank submits that under the liquidation proceedings, process is going on and it is at final stage. Since the matter is seized in liquidation process, therefore, the present proceedings are not maintainable.
Learned counsel for the respondent-Bank has also filed an application for exemption of presence of the General Manager of the respondent-bank, stating that due to unavoidable circumstances, the General Manager could not appear today before this Tribunal, but he has sent his Senior Manager Law Shri Shubham Bhargava to appear before this Appellate Tribunal and apprise about the quarries made by this Tribunal vide order dated 12.04.2023. The learned counsel also submits that the General Manager of the Bank, whose personal presence has been called for, has tendered apology for not appearing personally today. It is, therefore, prayed that the personal appearance of the General Manager may be exempted.
In view of the above, the General Manager of the respondentbank is exempted from personal appearance. Accordingly, the application stands disposed off.
