Heard the learned counsel for the applicant on the application for release of amount.
Learned counsel for the applicant submits that the Appeal Sr. No. 155/2018 was filed by the applicant against the order dated 07.05.2018 passed by the DRT, Lucknow in O.A. No. 841/2014, which was disposed off by this Appellate Tribunal vide order dated 27.01.2023 and the case was remanded back to the DRT concerned. It is further submitted that in view of section 21 of the RDB Act, the applicant had made pre-deposit for maintaining the appeal, which is still lying with this Tribunal. It is, therefore, prayed that the amount deposited towards pre-deposit may be released in favour of applicant.
Considering the submission as made above, the application is allowed and the registry is directed to release the amount, which was deposited for maintaining the appeal, along with interest accrued in favour of applicant within fortnight.
