THE APPELLATE TRIBUNAL :
IA No. 40 of 2023 is filed by the appellant u/s 5 of the Limitation Act praying for condonation of delay of 27 days in filing the appeal. Appellant has explained sufficient reason for the delay.
Despite service, none is present for the respondents.
Having heard learned counsel for the appellant I find that reasons explained in the I.A. to be sufficient for condoning the delay. Accordingly, I.A. 40 of 2023 is allowed. Delay is condoned.
Appellant has also filed I.A. 39 of 2023 praying for waiver from making pre-deposit. Learned counsel prays for and granted time for arguing on the waiver application.
