Heard the learned counsels for the parties.
Learned counsel for the appellant submits that in view of the order of the Hon’ble Apex Court in SLP No. 2522/2022Babasaheb Raosaheb Kobarne & Anr. Vs. Pyrotek India Private Limited & Ors., the period from 15.03.2020 till 28.02.2022 was to be excluded for the purpose of limitation on account of Covid-19 pandemic. It is contended that the written statement was filed during this period, therefore, it was filed within the time and the order dated 19.09.2022 passed by the Tribunal below is not sustainable.
In view of the above, the appeal is disposed off with liberty to the appellant to move an appropriate application before the Tribunal below with regard to his grievance, which he may have and the Tribunal below may decide the same most expeditiously in accordance with law.
