The report of the Registrar dated 01.02.2023 shows that an urgency application has been filed by the appellant along with the auction sale notice dated 18.01.2023 issued by the respondent-Bank, wherein the auction sale is scheduled to be held on 28.02.2023. In the said urgency application, it is also stated that after dismissal of the S.A., the SDM, Dehri-onSone is regularly visiting for taking over the physical possession of the property in question. Accordingly, list this case on 27.02.2023. In the meantime, the learned counsel for the appellant may file response regarding entertainability of the appeal in absence of mandatory pre-deposit amount.
