No pre deposit has been made. Waiver Application has been filed. As per Demand Notice (page 31-34 of instant Appeal) dues as on 31.03.2021 was Rs. 31,75,016=70 P + interest. It has been stated in the Waiver Application that the appellant deposited Rs. 9,94,502/= (Supplementary Affidavit in support of Waiver Application) Respondent-Bank. Ld. Counsel states that he will argue this issue before Hon’ble Court.
The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 08.12.2022 of DRT, Patna in S.A. No. 220/2022. Waiver Application (I.A. No. 29/2023) has been filed along with the Appeal.
