THE APPELLATE TRIBUNAL :
Perused order of the Hon’ble High Court of Orissa at Cuttack passed on 03.03.2023 in WP(C) No. 25567 of 2021. An affidavit filed by the appellants stating that after issuance of notice u/s 13(2) of the SARFAESI Act, 2002 they have deposited a sum of Rs. 3,87,38,877/-. In view of the submission made by the appellants and in view of the order passed by Hon’ble High Court, instant M.A. has to be registered as regular miscellaneous appeal as the condition of making pre-deposit u/s 18 of the SARFAESI Act has already been complied with. Accordingly, M.A. be registered by providing regular miscellaneous appeal number.
Respondents to file opposition within three weeks with copy to the appellants who may file rejoinder within two weeks thereafter.
List on 19.12.2023 for hearing of appeal.
