This matter has been taken up by me through Video Conferencing on being mentioned by the learned counsel for the appellant in view of urgency expressed.
Ld. counsel for the appellant states that he has deposited an amount of Rs.43,25,275/- , which is 25% of the remaining amount of debt due as per the mail sent by the respondent bank, towards pre-deposit.
Issue notice of application for waiver of pre-deposit (I.A. No.929/2022) and of application for condonation of delay (I.A. No.930/2022) to respondents/caveator by all permissible modes for 05.01.2023. Issue notice in the appeal also to respondents for the aforesaid date. These notices on the application for condonation of delay and in appeal are, however, subject to the decision to be taken on the waiver application.
