Learned counsel for the appellant submits that the appellant has made a pre-deposit of Rs.43,25,275/- which constitutes 25% pre-deposit and has filed an application for waiver of the balance 25% pre-deposit.

List the matter on 08.02.2023 hearing on the application for waiver of balance pre-deposit (I.A. No.929/2022), application for condonation of delay (I.A.. No.930/2022) and in appeal. Let reply be filed within two weeks and rejoinder, if any, be filed within one week thereafter, in the meanwhile.

Learned counsel for the respondent bank states that there is no imminent threat of taking over of the possession of the property in question and in case the bank intends to take possession of the property, it will give 15 days’ notice to appellant.
