Learned counsel for the applicant submits that the record of the DRT may be summoned to verify if any application was filed by the appellant-Bank through e-mail or not.
Learned counsel for the appellant-bank submits that the application was filed by the e-mail as at that time the Covid19 was on peak and it was the duty of the Registrar to place the said application before the Tribunal below.
In view of the aforesaid, the registry is directed to summon the record with regard to this case from the DRT concerned prior to the date fixed in the case.
List this case on 15.09.2023 for hearing.
