Heard the learned counsel for the applicant.
The present application has been filed under section 17-A of the RDB Act for transferring the S.A. No. 86/2022 pending before the Debts Recovery Tribunal, Dehradun to any other DRT.
It has been argued that the applicant had approached before the Hon’ble High Court of Uttarakhand twice, therefore, the Tribunal below was annoyed and was not passing any order on the interim application moved by the applicant, therefore, the applicant has no faith in the Tribunal below. On such contention, the order dated 09.01.2023 has been passed, copy of which has been filed at page no. 22 of the paper book.
Nothing has been recorded in the application with regard to the reason for transfer. As such no good ground has been made out for transfer of the case from the DRT, Dehradun to any other DRT under jurisdiction of this Appellate Tribunal. Hence, the present application for transfer is dismissed.
