A mention has been made on behalf of the learned counsel for the appellant that there is bereavement in the family of Shri Ashok Pandey, therefore, he prays for adjournment.
The office report dated 17.05.2023 shows that no affidavit of service has been filed to authenticate the service of notice upon the respondent no. 4 and no reply has been filed by the respondent-Bank to the delay condonation application. The said report further reveals that no pre-deposit has been made. Let the reply by the respondent-Bank and affidavit of service by the appellant be filed by the next date.
Learned counsel for the appellant may also explain as to how the appeal is maintainable in absence of pre-deposit on the next date.
