This appeal is coming up today for reporting compliance of statutory deposit.
As per conditional order dated 12.6.2023 passed in IA 124/2023(Waiver), appellants shall deposit a sum of Rs.36,03,065/- on or before 26.6.2023 and failure to deposit the same would result in dismissal of appeal. However, as per orders dated 27.6.2023 in IA 256/2023 (Extension of time), time is extended for payment of amount till 11.7.2023.
Today Ld. Counsel for appellants submitted that money is not deposited and sought further time. As it is a conditional order, request for further time is refused.
Therefore, Appeal AIR 2/2023 is rejected, by giving effect to orders dated 12.6.2023 & 27.6.2023 for non compliance of statutory deposit.
