Ld. Counsel Mr. Nemani Srinivas is present on behalf Applicant. He submits that the application being M.A. Dy. No. 82 of 2023 filed is covered by Article 137 of Limitation Act. Since no period of limitiation is provided for such nature of application so the limitation period will be 3 (three) years in this case. Submission in the prayer portion of the application is made for abundant precaution. Hence, prays to place the matter before the Hon’ble Chairperson.

The matter was listed today before registry bench for filing delay petition.

Received this Application (hardcopy) being No. M.A. Dy. No./82/2023 on 06/02/2023, filed by Ld. Advocate Mr. Nemani Srinivas on behalf of Smt. Gajjala Jayamma, the Applicant,with a request for recalling the order dated 25/07/2022 in Appeal No. 250 of 2018 and to pass an order permitting the appellant to deposit of Rs.10,00,000/- (Rupees ten lakh only) forthwith by condoning the delay, if any, in depositing the amount as directed for getting the appeal heard.

The Application is served upon Ld. Counsels for both the Respondents, appearing in Appeal No. 250 of 2018 by hand and same has been endorsed by the Counsels for respondents, on the face of the application.

Vide order dated 25/07/2023 passed by the Hon’ble Chairperson, Appeal No. 250 of 2018 was dismissed.
