Heard the learned counsel for the appellants.

Learned counsel for the appellants submits that the present appeal may be treated to be filed under section 17(A) of the RDB Act, 1993 for exercising the supervisory jurisdiction so that the necessary direction may be issued to the Tribunal below.

As prayed, the prayer of the learned counsel for the appellants is allowed and the appeal filed by the appellants is treated to be an application filed under section 17(A) of the RDB Act, 1993.

Learned counsel for the appellant further submits that the Tribunal below instead of deciding the issues raised by the appellants has stated that same shall be considered at the time of deciding the case finally, which defeats the purpose of the provisions of the Act and Rules made thereunder. It is further contended that the present case may be disposed off with liberty to the appellants to approach before the Tribunal below for raising their grievance.

In view of the above, the present application stands disposed off with liberty to the appellants to move appropriate application before the Tribunal below for redressal of their grievance, which may be decided most expeditiously in accordance with law and also in consonance of the order dated 07.02.2023 passed by the Hon’ble High Court in writ petition no. 8446 of 2018.
